Violences conjugales : un nouveau motif de déblocage de l'épargne salariale

Un décret paru au Journal officiel du 6 juin 2020 prévoit que les victimes de violences conjugales puissent débloquer par anticipation leur épargne salariale, afin d'avoir rapidement les moyens de s'éloigner de leur agresseur en cas d'urgence et de faire face aux changements matériels imposés par leur situation.

Jusqu'alors limité à un mariage, un Pacs, l'arrivée d'un troisième enfant, un divorce ou une séparation, le déblocage de l'épargne salariale est désormais possible en cas de violences commises contre une personne par son conjoint, son concubin ou son partenaire lié par un Pacs, ou son ancien conjoint, concubin ou partenaire.

Pour bénéficier de cette mesure, annoncée en novembre 2019 lors du Grenelle contre les violences conjugales, la personne doit avoir obtenu d'un juge la délivrance d'une ordonnance de protection interdisant à son conjoint violent d'entrer en relation avec elle ou ses proches.

Le déblocage est également possible si les violences font l'objet d'une information judiciaire, d'une saisine d'un tribunal, d'une mise en examen, d'une condamnation même non définitive, d'une alternative aux poursuites ou encore d'une composition pénale.
