Le Sénat, c'est quoi ?

Le Sénat est une assemblée représentative. C’est la deuxième « chambre » du Parlement français, la première étant l’Assemblée nationale. Pour désigner ce système de double représentation de la France et des Français, on parle de « bicamérisme ».
Les deux chambres du Parlement assument exactement les mêmes fonctions : examiner à fond les lois et les modifier, approfondir les grandes questions nationales et contrôler l’action du gouvernement. Mais à la différence de l’Assemblée nationale, le Sénat défend en plus les intérêts des communes, des départements et des régions, ce qu’on appelle les « collectivités territoriales ». L’Assemblée nationale, quant à elle, dispose du dernier mot sur le vote des lois. Cela veut dire que c’est elle qui décide au cas où le Sénat et l’Assemblée ne seraient pas d’accord.
Ainsi, pour résumer, les sénateurs représentent, enquêtent, délibèrent, légifèrent et contrôlent.
DE QUAND DATE LE BICAMÉRISME ?
De près de 140 ans ! Et même 218 ans si on considère que le premier Sénat date de 1795 – il s’appelait en réalité le « Conseil des Anciens ».
Le bicamérisme est un élément presque stable au sein de l’histoire, si mouvementée, de la France après la Révolution : à partir de son introduction en 1795, il n’a cessé d’être en vigueur que durant la très courte deuxième République (1848-1851) et pendant deux périodes de bouleversement (1871-1875 et 1944-1946) consécutives à des guerres.
Le véritable ancêtre du Sénat tel qu’on le connaît aujourd’hui, c’est le Sénat de la IIIe République. Créé en 1875, il comporte de nombreux points communs avec notre Sénat actuel : élection au suffrage universel indirect, fondée sur la représentation des collectivités locales, mandat de neuf ans (raccourci aujourd’hui à 6), renouvellement par tiers (par moitié aujourd’hui), pouvoirs législatifs…
